Members present:  Peter Conner, David Peck, William Keohan, Edward Conroy, James Simpson, and Mike Leary

Members absent:  Michael Main

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing:         Indianhead Realty, Inc. – Case # 3734
                        1929 State Road
                        2 Special Permits in order to construct a maintenance barn, recreational/athletic
                        fields & supporting equipment shed to enhance existing recreational
                        campground activities.

The Board received the following documentation* for review of this case:  
  • February 18, 2014 Continuance letter from Churchill Engineering
Richard Churchill, Applicant, asked for another continuance in order to have time to respond to the reviews from the Planning Dept, Engineering, and Beals and Thomas.  

Mr. Peck motioned to continue Special Permit for Case No. 3734 to May 7, 2014 @ 7:45p.m.   Mr. Simpson seconded.  

Granted unanimously (5-0)

Public Hearing:         McDe Realty LLC – Case # 3737
                        2240 State Road
                        Special Permit per Section 205-19 and Table 205-19-1 to exceed size in order to
                        construct and install a permanent identification pylon sign.

Mr. Keohan, the Clerk, read the February 19, 2014 letter from Atty. Edward Angley in to the record.  

The Board received the following documentation* for review of this case:

Mr. Peck motioned to Withdraw Without Prejudice the Special Permit for Case No. 3737.  Mr. Simpson seconded.

        Determination as to substantial/non-substantial modification of the
        Comprehensive Plan relative to a change in ownership

Jim Freeman, Freeman Realty Associates, explained that he currently does not own the property; however, he has the property under a Purchase & Sale Agreement and that he hopes to take title by the end of the month.  He noted that they will be acquiring the property as is.  He provided a brief history of his professional experience.  Mr. Freeman then reviewed some existing conditions and proposed conditions.  He closed by discussing the partnership between Freeman Realty Associates and Miller Starbuck.  

Mr. Conroy motioned that the proposed transfer of ownership of Comprehensive Permit for Case No. 3329 to a future owner is an insubstantial modification.  Mr. Peck seconded.

Granted unanimously (5-0)


Informal:               Anderson – Case #3735
                        5 Theatre Colony Way
                        Condition No. 1 – Informal to show a site plan that reveals adequate parking for
                        two vehicles.

Robert Wollner, Wollner Construction, representing Applicant, was present.  

Mr. Peck motioned to approve the plan as presented thereby satisfying Condition No. 1 for Case No. 3735.  Mr. Conroy seconded.

Approval of February 12, 2014 ZBA Meeting Minutes

Mr. Peck motioned for the Board to approve the February 12, 2014 Meeting Minutes as presented.  Mr. Keohan seconded.

Approval of February 19, 2014 ZBA Meeting Minutes

Mr. Keohan motioned for the Board to approve the February 19, 2014 Meeting Minutes as presented.  Mr. Conroy seconded.

Agreed unanimously (5-0) – Abstention:  Mr. Leary

Mr. Conroy motioned to adjourn the meeting.  Mr. Peck seconded.  Agreed unanimously (6-0)
